買來的房子發現漏水，怎麼辦？

房子在交屋後發現有漏水，這時候要如何處理？
建議解決的SOP如下：
(1)最好在交屋之後，就盡快檢查房子有沒有瑕疵！
在交屋後的五年內發現房子有瑕疵，買方都可以主張賣方要負瑕疵擔保責任。
這個做法能避免日後買賣雙方，對於瑕疵為何時產生而有所爭議？(例如地震過後，誰能證明牆壁裂縫是何時就有的？) 若有爭議，買方就要負舉證責任。
(2)買方在發現問題後，立即通知賣方。
為避免日後爭議，建議以存證信函通知，較為正式。
如果不知道賣方的聯絡地址，使得存證信函無法送達給賣方，也沒有其他能聯絡賣方的管道，這時候就只能提出訴訟或向法院聲請調解。
(3)通知後六個月內，買方要選擇解除契約或是減少價金，二種方法擇一。
因為解除契約事關重大，不是買方說要解約就可以隨便解約的，要考量解約是否顯失公平。通常都會以是否屬於重大瑕疵來判斷。
